1. The agreement

These Terms of Service ("Terms") form a binding agreement between you and DeedScout ("we", "us", "our"). By creating an account, subscribing, or using the website, you agree to these Terms. If you do not agree, do not use the service.

2. Not legal, financial, or investment advice

Important DeedScout provides reference information and research tools for Florida public records. We are not a law firm, a title company, a real estate brokerage, a registered investment adviser, or a government agency. The platform provides public-record research tools only. Nothing on this site constitutes legal, tax, financial, or investment advice. Tax deed investing carries substantial financial and legal risk — including the risk of total loss of your bid amount. Users are responsible for verifying all information through official county, municipal, court, property appraiser, tax collector, and clerk sources. Always consult licensed Florida counsel and conduct independent due diligence before bidding on any property.

4. Subscriptions, billing, refunds

Pricing. The Pro subscription is billed monthly at the price displayed on our pricing page at the time of purchase. We may change pricing for new subscribers at any time, but we will give existing subscribers at least 30 days' notice before any price change takes effect for them.

Billing. Subscriptions are billed in advance on a recurring monthly basis through Stripe. By subscribing, you authorize us, through Stripe, to charge your selected payment method for the recurring subscription fee.

Cancellation. You may cancel at any time from the Account page. Cancellation takes effect at the end of the current billing period; you retain Pro access until then.

Refund policy. If you are not satisfied with the Pro subscription within seven (7) days of your initial paid subscription, contact us for a full refund of the most recent payment. After seven days, payments are non-refundable. We do not pro-rate partial months.

Failed payments. If a recurring payment fails, your Pro access may be suspended. We will retry the payment a few times before cancelling.

Taxes. Prices do not include sales tax. Where required by law, applicable taxes will be added at checkout.

6. Data accuracy and verification

We strive to maintain accurate, current information about Florida tax deed sales, county Clerk pages, surplus funds, and statutory references, but we make no warranty as to accuracy, completeness, or timeliness. County websites change without notice. Sale dates, parcel lists, opening bids, and surplus claim deadlines must be independently verified with the County Clerk's office before you take any action in reliance on them. The "Last verified" timestamp shown on each county is when we last reviewed the source links — not a guarantee of current accuracy.

7. Intellectual property

Our content. The website design, code, text, statutory summaries, and aggregated data compilations are owned by us or our licensors and are protected by copyright and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the service for your personal or internal business research purposes.

Public records. Underlying tax deed records, court documents, and statutory text are public records of the State of Florida and are not our property.

Your content. You retain ownership of content you upload (e.g., notes, watchlist entries). You grant us a limited license to store, transmit, and display that content as necessary to operate the service.

8. Third-party links and services

The service contains links to third-party websites (county Clerk pages, auction platforms, the Florida Senate website, etc.) and integrates with third-party providers (Supabase, Stripe). We are not responsible for the content, privacy practices, or availability of third-party sites or services.

9. Term and termination

These Terms remain in effect while you use the service. We may suspend or terminate your account at any time if you breach these Terms or if we reasonably believe you have engaged in fraud, abuse, or unlawful activity. You may terminate your account at any time from the Account page; see the Privacy Policy for what happens to your data after termination.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT INFORMATION DISPLAYED ON THE SERVICE IS ACCURATE OR CURRENT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE OR OUR OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF THE SERVICE.

OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless DeedScout and its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the service.

13. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

You and we agree that any claim must be brought in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect the change. Material changes will be communicated to active subscribers by email at least 14 days before they take effect. Your continued use of the service after the effective date of a change constitutes acceptance of the revised Terms.
